1. APPLICATION
Except for prior written agreement, the general conditions of sale supersede all other conditions, and are the only ones to apply. By using the services, you agree with all the terms of the same, which may be updated without prior notice, so you should check this page periodically in order to become aware of any changes that may have been made to the general conditions of sale.
2. PRODUCT INFORMATION
The photographs presented are for illustrative purposes only and may not correspond to the configurations described, and therefore do not constitute any commitment to exact correspondence to the product. The technical characteristics and descriptions of the products may occasionally contain an error or inaccuracy. If the customer has any doubts in the correspondence of the product regarding what he wants, he should indicate whenever possible, and confirm with TUCALED before making the purchase. In case of special references on the products, as a recommendation for assembly by professionals, TUCALED does not provide technical advice beyond what is described in the documents accompanying the products, if applicable.
Any damage resulting from connection or assembly error by the customer, this will not be TUCALED's responsibility, and the products will not be damaged for reasons attributable to the customer, eligible under the warranty. The decision and analysis are in these cases the sole responsibility of TUCALED and in some cases of the product manufacturer.
3. PRICE
The sales prices displayed on the Tucaled.com online store are shown in Euros, including VAT. The values for shipping costs for goods are borne by the customer, they are calculated and presented at the end of the purchase process, depending on the products selected and there may be eligible bonuses depending on the policy in force and announced on Tucaled.com.
TUCALED reserves the right to change prices without prior notice, at any time, and the price charged is the one announced at the time the customer completes the online purchase and payment.
In case the indicated price is incorrect and evidently insignificant, regardless of the cause being a computer, manual, technical error, etc., this order will be canceled by TUCALED, even if it is already confirmed and finalized, proceeding to the refund later .
4. SHIPPING CONDITIONS
Packages are shipped by the transport companies after confirming your order and always before 17:00 on Monday to Friday weekdays.
5. AVAILABILITY
Products available in stock are shipped on the business day following confirmation of payment.
On each individual product page the stock availability of each product is present and referenced. These quantities are the sum of existing stocks in store and warehouse.
If one of the ordered products is not available within the deadline shown on the website, TUCALED will contact the customer by email or phone in order to communicate the expected delivery period or in some cases to propose its replacement, if there is a break. of stock at the manufacturer or the product has been discontinued.
The stock information may at certain times be incorrect, essentially motivated by the constant updates of the website automatically, it is therefore advisable to confirm with TUCALED by the client, in order to avoid delays and possible unavailability.
The stock quantities shown on the TUCALED website are not a commitment to accuracy, as they may be subject to constant updating.
In replacement of the product that is available, the customer may opt for another equivalent, being made an adjustment in the values. If the customer opts for a refund, TUCALED will proceed with the corresponding refund for unavailable products.
TUCALED reserves the right to cancel orders or non-acceptance of these (even after completion of the order and paid), whose items are not in stock, or whose manufacturer requires minimum purchase quantities.
Products that are not immediately available in stock, in TUCALED's warehouses and store, after the customer's order, will only be ordered from the manufacturer after payment of the order has been made.
6. PAYMENT METHODS
The payment methods available are: Paypal, Entity and MB reference, MBWAY and Bank transfer.
Note: for materials that are not from our usual stock (which have to be purposely ordered from the manufacturer) they cannot be sent at collection and must be paid in full before shipment or at the time of ordering.
6. DELIVERY
Products purchased at TUCALED.COM are delivered in mainland Portugal. If the customer wants to send or receive their purchases in the Islands or in another country, they must contact us in writing for our services, and thus provide them with a quotation for the shipping cost.
TUCALED does not deliver to PO Boxes.
The order will be delivered by default to the address indicated by the customer when registering on the TUCALED.COM website.
In case of non-receipt, the customer must contact TUCALED, and there must be a verification and confirmation of the loss of the order with the carrier, before proceeding with a possible refund.
The customer must always, when receiving their order, open the packaging and verify the product, and if it is in accordance with what was requested and does not have visible external defects.
If the product is not the one purchased or has visible defects, TUCALED strongly advises the customer to refuse delivery, return the product to the carrier, who will take care of the return, and to contact TUCALED immediately by e- mail or through the form provided for this purpose at TUCALED.COM.
The goods are carried at the customer's expense and risk.
When the package is delivered by the carrier, TUCALED is not responsible for any problems arising during transport. TUCALED will not accept any request for refund or replacement for products that have external defects and that have been accepted by the customer at the time of delivery.
In cases of technical problems detected by the customer after delivery and in accordance with the terms provided by law, the right of withdrawal remains valid.
In case of absence at the place of reception of goods, stipulated by the customer at registration and at the time of the order, if it is not delivered, TUCALED is entitled to refuse any refund. If a rescheduled delivery of the merchandise is desired, the customer must contact TUCALED and schedule a new delivery and respective payment.
In case of non-conformity of the material ordered upon receipt, the customer has 24 hours after receipt to file a complaint and contact our support line through the usual contacts, indicating the invoice number and the respective non-conformities. You will later receive notification by email or telephone contact with the following procedures.
7. WARRANTY CONDITIONS
Two-year warranty against manufacturing defects from the date of purchase.
i) In case the product has any manufacturing defect within the warranty period, TUCALED will repair or replace it.
The customer must send the product that is defective or has some type of malfunction to TUCALED's facilities, so that a technical analysis can be carried out on the product in question. This analysis will be carried out in the shortest possible time and will be decisive for the decision to repair or replace the product.
ii) The repaired or replaced product will be delivered to the customer in the same way as chosen by the customer at the time of purchase.
iii) This warranty does not provide coverage for damage caused by natural disasters, accidents, misuse, abuse, neglect, modification or alteration of any part of the Product. The warranty also does not cover damages affected by misuse or inadequate maintenance, connection to power supplies not designed for this purpose or alterations thereto made by the customer or by the customer's responsibility.
iv) TUCALED is not responsible for any direct or indirect damage that may result from product malfunctions, even if these are eligible under warranty.
v) In the act of claiming a warranty, the customer must always present the purchase invoice to TUCALED in order to prove that the product is within the warranty period.
vi) In case of impossibility of repairing or replacing the product as it is no longer sold, TUCALED reserves the right to replace it with an equivalent product or refund the amount spent by the customer.
vii) All equipment is covered by a 2 year compliance guarantee from the invoice date, as stipulated in DL 67/2003 of 8 April, with changes introduced by DL 84/2008 of 21 May (Guarantee of Consumer Goods and After-Sales Assistance), for private customers. For professional Customers, the warranty time is 6 months from the date of purchase. Excluded from this 2-year warranty are goods considered to be worn out such as any type of lamp* with the exception of LED lamps, which have a 2-year warranty.
*Lamps are considered a wear product due to the conditions to which they are exposed, namely, voltage peaks, atmospheric discharges, noise and harmonic "trash", temperature differences. In this case, TUCALED grants a 90-day warranty period.
viii) In case your product has broken down within the warranty period and has been discontinued by the brand, it will be replaced by one with similar characteristics (equal or superior) of the current generation of the same manufacturer, even if the value of the new product is higher than the damaged.
ix) The maximum period for sending products exchanged/repaired under warranty is 1 month from the date of receipt at TUCALED's premises.
8. RETURN CONDITIONS
Products purchased on the TUCALED.COM website have a legal period of 14 days in which the return can be made, and the total cost of returning the products is the responsibility of the consumer.
The reflection period ends 14 days after the date of delivery of the goods.
In the case of service contracts, the reflection period ends 14 days after the date of conclusion of the contract. If the end of the reflection period does not fall on a working day, it is extended until the first following working day.
Returns of products that do not have immediate stock at the time of order are not accepted, and have been purposely requested from the manufacturer, as well as returns and/or exchanges of cuts of cables, wires, steel cables and/or any other type of item that is sold by the meter.
In order for the return to be valid, the products in question, as well as their packaging, instructions, labels and documents, must arrive at our facilities in perfect conditions of use, otherwise the consumer will lose the right to a refund.
After examining the product by TUCALED technicians, the customer will be informed of the right to a refund of the amounts paid.
Once the return conditions are assured, the refund will be processed by bank transfer within a maximum period of 14 working days.
14-day cooling off period
In the EU, you are entitled to return orders placed Online or through other distance selling, such as by phone, by mail or to a door-to-door seller, within 14 days and to be fully refunded. You can decide to do so regardless of the reason, and you are not obliged to give a justification.
The 14-day cooling off period does not apply to all types of purchases.
Some sellers do not charge anything for the return of goods. However, if this is not the case, they must inform customers in advance, that is, before they place an order, that they have to pay something if they decide to return the purchased items. If they don't, it's up to the sellers to bear these costs. You are not required to pay any other charges that you have not been informed about in advance.
ORDER CANCELLATION
The consumer may cancel his order at any time up to the day and time that the order is placed with a carrier, with the right to a refund of all amounts paid.
Upon receipt of the order by the consumer, he may exercise his right of free withdrawal under the legally established terms and indicated below, namely, in Decree-Law no. 24/2014, of 14 February.
